Terms of Service

Who We Are

These Terms of Service govern your use of Pilot Guardian. The system is owned by Crestline Defence (Pty) Ltd, which provides the infrastructure and technical support, in partnership with Semper Primus (Pty) Ltd, which manages client relationships.

Description of the Service

Pilot Guardian is a software platform that helps users upload and organize flight recordings in their own connected Google Drive. The service provides the infrastructure and software layer for upload routing, file organization, and business workflow support.

Eligibility and Business Authority

You may use the service only if you are legally able to enter into a binding agreement and, when acting for a company, have authority to accept these terms on that company's behalf.

User Responsibilities

You are responsible for:

• Providing accurate account and operational information.
• Maintaining secure access to your account, devices, and credentials.
• Ensuring your use of the service and uploaded content is lawful in your jurisdiction.
• All content submitted through your account or connected devices.

Google Account and Google Drive Connections

You are responsible for maintaining access to your Google account and authorizing the permissions needed for Pilot Guardian to function. You acknowledge that revoking required permissions may limit or stop upload functionality.

Acceptable Use

You must not:

• Use the service for unlawful, fraudulent, or abusive activity.
• Interfere with or attempt to bypass service security or availability controls.
• Upload or route content in violation of third-party rights or applicable law.

Service Availability

We work to provide reliable operation, but the service is offered on an "as available" basis. We do not guarantee uninterrupted or error-free availability at all times.

Customer File Ownership and Control

You retain ownership and control of files uploaded through the service. Uploaded files remain in your own Google Drive account under your account controls and policies.

Limited Access Statement

• We provide infrastructure to upload and organize files.
• We do not claim ownership of customer files.
• We do not view or monitor user video content as part of normal service operation.

Fees, Billing, and Subscription

Access to Pilot Guardian is provided on a paid SaaS subscription basis. You agree to pay applicable recurring fees and any related taxes, and to keep billing details current.

Suspension and Termination

We may suspend or terminate access where reasonably necessary, including for non-payment, security risk, or violation of these terms. You may stop using the service at any time.

Intellectual Property

The Pilot Guardian software, branding, and related platform materials are owned by their respective rights holders and are protected by applicable intellectual property laws. These terms do not transfer ownership of the platform to you.

Limitation of Liability

To the maximum extent permitted by law, Crestline Defence (Pty) Ltd and Semper Primus (Pty) Ltd are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business opportunities arising from use of the service.

Indemnity

You agree to indemnify and hold harmless Crestline Defence (Pty) Ltd and Semper Primus (Pty) Ltd from claims, liabilities, and expenses arising from your content, your use of the service, or your violation of these terms or applicable law.

Changes to the Service or These Terms

We may update the service or these terms from time to time. Updated terms become effective when posted, unless a later date is stated. Continued use after updates means you accept the revised terms.

Governing Law

These terms are governed by the laws of the Republic of South Africa, and you consent to the exclusive jurisdiction of the South African courts for any dispute arising out of or relating to these terms or your use of the service.
